Frenchman Dies While Having Sex During A Business Trip, Court Rules It As “Workplace Accident”

The Frenchman who passed away of a heart attack while having sex during a business trip for a railway company a couple of years ago is a victim of a workplace accident, said the court.

Xavier, a safety technician for a railway company, was on a business trip to Loiret Region, which is 90 miles away from Paris, when the incident happened in 2013.

The Frenchman had sex with a complete stranger.

While having sex with the stranger, M. Xavier suffered a heart attack and passed away.

Earlier this year, the Court of Appeal of Paris ruled the death of M. Xavier as a “workplace accident”.

But the employer argued that the death was not the responsibility of the company as his sexual activity was not part of the business trip and because he passed away in a different hotel.

The company said the incident “occurred when he had knowingly interrupted his work for a reason solely dictated by his personal interest, independent of his employment.”

The company added that the death did not have anything to do with his work performance.

The court said that it does not matter whether an accident happened during work time or personal time unless an employer has proof that an employee had to stop working on his business trip due to personal reasons.

The Paris Court also said that the sexual activity is a matter of everyday life, which is similar in taking a shower every day and eating.
