India’s apex judicial body Supreme Court has penalized the Tamil Nadu state. Supreme Court penalized Tamil Nadu with Rs. 1.7 Crore as compensation to a young girl. Although the Tamil Nadu state hasn’t responded to the penalization and punishment stated by the Supreme court in an official judgement.

Supreme Court strongly condemned doctors negligence of Tamil Nadu state. Supreme court penalised Tamil Nadu state government with huge sum of Rs. 1.7 crore to pay a young girl as she lost vision soon after birth due to medical negligence by doctors of a government hospital in Tamil Nadu.

This epic judgement was delivered by the Supreme court on Wednesday decrying the negligence of Tamil Nadu doctors sentencing Tamil Nadu government with Rs. 1.7 crore. Supreme court bench constituting Justices J S Khehar and S A Bobde sentenced a highest ever compensation in the country, Rs 1.3 crore. Supreme court additionally added an additional amount of Rs 42 lakhs to take care of the medical treatment that the 18-year-old girl would require.

Tamil Nadu government was ordered by the Supreme Court to hold the Chennai Egmore’s government hospital doctors guilty of gross medical negligence and to pay the compensation after doing so. The victim, girl, was born prematurely at the hospital on August 30, 1986 and was placed in the Intensive Care Unit (ICU) incubator for 25 days of Chennai Egmore government hospital.

After discharging girl, Chennai Egmore government doctors failed to prescribe a test for the Retinopathy of Prematurity (ROP)disease despite girls regular visit to the hospital. Retinopathy of Prematurity (ROP) is usually frequent in cases of premature births. And by the time the girl was diagnosed with Retinopathy of Prematurity (ROP) by the private doctors it was too late to treat her and get back her vision.

Supreme court bench of Justices J S Khehar and S A Bobde found no exoneration and convincing facts for not testing the girl by the doctors during her infant age thus held them accountable. Advocate Nikhil Nayyar who represented the girl demanded for the justice and his arguments were considered as pleasing and agreeable by the Supreme court bench. Girl, victim, remained under constant care of the hospital’s doctors and hence the liability had to be fastened upon them and the state government.

Nikhil Nayyar alleged that Dr. Duraiswamy who was working in the Neo-natology unit of the hospital paid a visit to the girl at least six times between October and November, 1986 but he or any other doctor never told the parents that a premature baby is prone to a higher risk of retinal detachment, nor were they informed that an internal examination of eye by an ophthalmologist was required.

Admitting lawyers allegations the bench of supreme court dismissed Tamil Nadu state government’s appeal against the order of compensation by the National Consumer Disputes Redressal Commission. Supreme court simultaneously approved the plea by girl’s father V Krishnakumar to enhance the damages. National Consumer Disputes Redressal Commission granted a compensation of Rs 5 lakh in 2009 which hasn’t been paid by the state government till date to the girl.
