Large section of Indian citizens might have been surprised by a recent statement by Minister of State for Home, Haribhai Parathibhai Chaudhary who said that ‘Marital Rape’ Is legal. “It is considered that the concept of marital rape, as understood internationally, cannot be suitably applied in the Indian context due to various factors, including level of education, illiteracy, poverty, myriad social customs and values, religious beliefs, mindset of the society to treat the marriage as a sacrament,etc” said Haribhai Parathibhai Chaudhary. He further added “The Law Commission of India, while making its 172nd Report on Review of Rape Laws did not recommend criminalization of marital rape by amending the exception to Section 375 of the Indian Penal Code and hence presently there is no proposal to bring any amendment to the IPC in this regard”.

Which makes it clear that Govt. of India has cleared its stand on marital rape stating it as NOT a crime. Perhaps this new stand of Indian government may change the minds and opinions of rest of the world who opine that India is the country with the ‘rape problem’ makes as the news Govt. of India found a new way of legalizing the rape in India.
