Mother throws Newborn Daughter out of window from seventh floor, arrested

A woman who apparently hid her pregnancy from her boyfriend, gave birth to a baby daughter in his New York City home and then tossed her to death from a seventh-floor Bronx apartment window was arrested Tuesday on murder and manslaughter charges, police said.

According to sources, Jennifer Berry, 33, a former child welfare worker told cops that the baby was delivered inside the apartment shower. She claimed the newborn wasn’t breathing and she threw the baby, as well as the placenta, out the window.

Horrified neighbors found the newborn’s remains in the building courtyard around 2:30 p.m. and called police. They had responded to the building after receiving a call that an infant had fallen from a window. Police officers said they found Jennifer Berry’s infant daughter with her umbilical cord still attached, in a courtyard of her boyfriend’s Bronx apartment building on Monday afternoon. Berry was being held Tuesday in police custody pending her arraignment and couldn’t be contacted. It was unclear whether she had an attorney who could comment for her.

Berry’s boyfriend, Giovanni Johnson, 28, told police he was in another room when the baby was born and when the baby plunged from the window. He told investigators he didn’t realize either event had occurred and had no idea his girlfriend was pregnant, officials said.

Johnson, who had been in a relationship with Berry for around a year and a half, said that he had been under the impression she’d had an abortion. ‘I didn’t know (about the pregnancy),’ he said. ‘I didn’t know any of this. I’ve been cleared of all charges.’ Johnson told police Berry had been pregnant months ago, but she told him she had had an abortion, according to sources.

Neighbors rallied behind Johnson who grew up on W. 183rd St. and has a 3-year-old boy with another woman. Berry, who lives in Yonkers, started showing up at the apartment about a year ago, they said.

An autopsy determined the infant’s death was a homicide caused by multiple blunt-force trauma, chief medical examiner Dr. Barbara Sampson said Tuesday. The baby’s death was ruled a homicide, meaning she had been born alive.

“She gave birth to an 8-pound girl and dropped the newborn seven stories to the pavement. The medical examiner has determined that the baby was alive,” Barker told the judge. “There was air in the lungs, this was a healthy baby girl,” Barker said.

In a gut-churning twist, records indicate Berry was once employed by the Administration for Children’s Services. A source said she had “minimal contact with families,” when she worked for the agency for six months in 2007 and 2008.

This isn’t the first recent incident of a child being thrown out of a window in New York. Early in August, a 1-month-old was thrown to his death from a fourth-story window in Queens. Berry was remanded without bail. She next appears in court on Oct. 5.
