Muslim Woman Divorced Via Speed Post, Moves SC Demanding Ban On ‘Triple Talaq’
Afreen Rehman is 25 years old and recently got some shocking mail and not just a regular mail and its speed post. Against the triple talaq system, a Muslim woman on Wednesday moved the supreme court to nullify the prevailing divorce practice.
She says a man can divorce his wife by saying ‘talaq’ as many times he can during his wife`s period. Divorce is always instantaneous for him by saying the word ‘talaq’ three times which is called unilateral triple talaq.
“I got married in 2014 through a matrimonial portal. After two to three months, my in-laws started mentally harassing me by demanding dowry,” Rehman said.
“Later, they started beating me up and asked me to leave. I came to my maternal home and now I have received speed post announcing divorce. This is completely wrong, unfair and unacceptable. I have filed a petition in the Supreme Court seeking its intervention into the matter,” she added.
All India Muslim Women Personal Law Board president Shaista Ambar is demanding the abolition of triple talaq. The high-level committee is set up by Centre to review the status of women in India and considering the reports which are recommended a ban on the practice of oral, unilateral and triple talaq as well as polygamy.
As per Quran and Hadith, saying three times the word Talaq is a crime, but few people say that this process cannot be changed says the Muslim Personal Law Board spokesman Maulana Abdul Raheem Qureshi.
According to Muslim Marriages Act, 1939 says that it fails to provide Indian Muslim women from bigamy which is challenged by the petitioner.
