Amid a lifestyle of the competitive world, many of us fall prey to many schemes of companies and individuals. Despite being cheated many of the victims step back to fight for the rights they have been denied and cheated and to take a legal action against them. This kind of frauds have been witnessed where most of the consumers are cheated and misguided with the fraudulent schemes of companies. Indian government consumer forum has been in the aid of such consumers in preserving their rights against the chiseling companies. A screwed consumer by a company or organisation has the right to forfeit his case and rights in the consumer forum although many of the consumers across the nation are scared of filing a case in the consumer forum apprehending all the harassments and extra expenditures they might have to go through.

Rajesh Sakre Bends Down India’s Largest Bank to His Feet

Indian judiciary isn’t such an annoying as it is decribed usually among the middle class. Many of the people in India live in a unconcious state where they aren’t aware of the fact that Indian law gives them right to fight to preserve their rights, so does consumer forum. Rajesh Sakre tea commoner and tea vendor fights his own case despite have money to hire a lawyer but had he courage and faith to stand up for his rights and bring the wrongdoer to justice. Rajesh Sakre is perhaps is one of the brave consumers of India have brave hearts for their rights preservance. He faced injustice from India’s larges public sector bank the State Bank of India (SBI) in December 2011 regarding a sum of Rs. 9,200/- that was debited from his account without his knowledge.

Rajesh Sakre questioned the state bank of India about the suspicious and unacknowledged withdraw of Rs. 9,200/- from his bank as he ever withdrew this amount from his bank account. Rajesh Sakre stated that he had Rs. 20,000/- in his State Bank of India bank account on 23rd December 2011 and he had withdrawn a sum of Rs. 10,800/- on the same day. He was astonished to see his account showed zero balance after returning to the State Bank of India branch he had his account to withdraw more cash. Due to negligence or some error committed by the bank the remaining balance from his account was missing from his account without his knowledge and participation.

Despite asking and questioning about the mishap to the bank he blamed for negligence on his complaint and the fficers at Hamidia Road Branch of the SBI took no responsibility for this matter. Realising no support from his bank branch sent a written complaint to the SBI, Mumbai Headquarter. Rajesh Sakre a resident of the Shabri Nagar in Bhopal waited for the response while his hopes were turned down as he didn’t receive any answer from the SBI.
Annoyed with this sort of pathetic customer service from the State Bank of India moved the District Consumer Disputes Redressal Forum (DCDRF) with his complaint.

District Consumer Disputes Redressal Forum (DCDRF) considered his ple and stood by his side to get the justice. Despite being questioned by the consumer forum State Bank of India repeatedly said that it was Sakre who had only withdrawn the cash from the bank. Although the bank failed to produce any evidence for the same and added to this when being asked to present CCTV footage by the consumer forum it had failed to do so this made it clear it was an internal error and negligence of the bank which made the sum of Rs. 9,200/- disappeared from the account of Sakre. Despite his courage it was a tough battle for him as was merely a literate who studied only till 5th standard in school.

Over dozen of times leaving behing his daily bread earning business, he had to attend the courts hearing although he didn’t give up and stood for his right, what was the truth. On being asked he said it was his right, how could he let it go? He kept on speaking for himself to the magistrate as he had no money to hire a lawyer to fight his case. Rajesh Sakre was strong enough till the end and it was on June 16, 2015 District Consumer Disputes Redressal Forum (DCDRF) ordered the State Bank of India to pay back his sum of Rs. 9,200/- with a 6% rate of interest within 2 months. And added to this DCDRF penalised SBI with a sum of Rs. 10,000/- for mental distress that faced by Sakre during that time, with additional Rs. 2,000/- for fighting the legal matters.
